JOHN WORLEY FAMILY CHRONOLOGICAL EVENT ANALYSIS


    Just what is the true about our John Worley? Let me set out some seemingly facts and paint a possible senario to match them.

    1. There is a John Worley that was born in the later 1600s who married a Mary Long and patented 340 acres of land on Mar. 9 1717 called 'Harises joining Albemarle Sound, Mr. Jacob Blount, Middle Neck Swamp.' This purchase, along with 155 acres patented on Mar. 25, 1714 and called 'Beach Neck on South Side of Middle Neck Swamp,' was deeded to his son Joshua, 'eldest son of my dead wife, Mary Worley' on March 4, 1729. (Tyrrell County Deed Book 1, 67(85))

This would make John Worley's oldest son Joshua Worley the son of Mary Long, John Worley's presumed first wife. And that might also include such children of John Worley as Elizabeth who marries Thomas Leary, Penelope who marries William Wight and Mary Worley who marries Thomas Norcum. And these would be the primary characters of John Worley's will of February 1740. That John Worley died in short order relative to that will seems apparent from a number of circumstances. The items in that will are when written so written in a 'past tense' of 'I gave' rather than 'I give'. And who might just be a second wife, 'estranged' for whatever reason(s), Seems to 'rush' in to be named as the 'administrator' of the estate of the deceased John Worley even before such will can be registered. To merely 'assume' that Hester Blount is not the second wife of this John Worley is to ignore to other seemingly pointed events of evidence. That is there is a series of 'law suits' between Hester Blount's brothers and Joshua Worley and Thomas Leary over some seeming related matter. And then within that same time frame suddenly the estate of John Worley which is mentioned in his will is then set to auction rather than to be distributed according to his will. The prime example of this is that Thomas Leary ends up bidding for and buying at that 'estate auction' the very negro slaves which John Worley had willed to his wife Elizabeth Leary in her father's will. So just what was the 'contention' that was brought that would make John Worley's estate go to 'estate auction' rather than to be distributed according to the dully registered will?

    2. The Minute Book of Pleas and Quarterly Sessions of Tyrrell County March 1740 exihibited in Court by an oath of Esther Worley claimant to being the 'administrix to the estate of said John Worley'. (Minute Book of Pleas and Quarterly Sessions of Tyrrell County, North Carolina, #74, March 1740. & Szucs, L.D. And Luebking, S. H. The Source: A Guidebook of American Genealogy. Ancestry, Inc., Salt Lake City, Utah, 1997.)

    3. 1741-Col John Worley's inventory. Tyrrell County. Attested in Edenton by Thomas Leary on 28 May - Early Records of NC. — Sale on July 20 of part of the estate of Col. John Worley dec'd. Buyers include Joshua Worley and four others as John Worley's will did not settle the matter. (from Early Records of NC.) Further sale on 18 August of another part of the estate of Col. John Worley dec'd. Buyers were Joshua Worley, who bought 225 acres (which the will would have given him) and Thomas Leary who had to buy the three slaves that Elizabeth Worley Leary would have received under the terms of the will including 'Moll' and 'Boston' mentioned in John's will. Other buyers Elizabeth Leary and Joshua Turner. (Early Records NC). Sept 13, 1741, still another sale of part of the estate of Col. John Worley dec'd. Buyers were Joshua and Thomas Leary. 4. Blounts' Case against Worley. Aug. 13 1742. Order to the Sheriff of Tyrrell Co. to summon Thomas Leary & Joshua Worley planters of Tyrrell Co. as executors of John Worley Sr (dec'd) to appear in General Court at Edenton to answer Thomas Blount and Joseph Blount in a plea for 100 pds. (Early Records NC). Again Oct. 1742 Blounts' Case against Worley, General Court. Thomas Leary & Joshua Worley were attached to answer the Blounts. The Blounts complained that John Worley did on Aug. 4 1739 at Tyrrell Co. become indebted to them in the sum of 43 pds., 17 shillings, & 12 shillings & 6 pence in "Light pay," to wit, in deer skins at 5 shillings & 6 pence a pound weight. (Early Records NC) Still again Blounts' Case against Worley. February 5, 1743. Order to Will Barrot cleark of Tyrrell Co. Thomas & Joseph Blount plaintiffs had brought suit against Thomas execurtor of John Worley dec'd defendant. Order was for Barrot to appear and bring all accounts, inventories, & other papers filed in his office by Thomas Leary as executor of said John Worley. Still again-Blounts' Case against Worley, 1 March 1743. Order to the Sheriff of Tyrrell Co. to summon Thomas Bateman to appear to testify in the case.

    5. Other lingering issues related - Joshua Worley hit as taxpayer on 5 w 13b slaves (1743). Next 1743 Next at Edenton - Joshua Worley was admitted at a council to have rights to land with 5 whites and 13 blacks. 3/22/1743-three years after the will was proved. Next higher court at Bath-Joshua Worley received a grant for 150 acres Tyrrell 3/8/1743 had set it out. Then - Patent - Tyrrell - Joshua Worley - Crown to Joshua Worley, 150 acres in Tyrrell Co. joining Welches creek and the pocosin. But then again Tax on Taxpayer Joshua Worley 5w 13b slaves 1743.

When one persists in 'revenges', it but seems to tear one's self down. So then within a those few years, this Ester Worley [Blount] does herself die likely early 1744, leaving her children to be orphans. This would seems to support the concept that she was indeed the wife of John Worley, and because she was not included in the will of John Worley, nor neither were her children by him so included, that there must have been an estrangement of some nature, whatever that nature of which might have been. And this would suggest why her children, which includes still another John Worley (jr), were not in their father's will (that is Col. John Worley (Sr.) to that much younger son John Worley (jr.) who would have to be set out as an 'orphan'. (This in itself should preclude that a John Worley Jr. son of Col. John Worley Sr. was he who married Hester Blount for 'he' John Worley Jr. was still yet a minor when his mother died. And as to that other John Worley Jr. of Beaufort he is in 1744 being granted 200 acres at a council held at Newberry. And if one follows that John Worley Jr. they'll see that he is of another Worley family, though paths do cross, and they are not of the Tyrrell Worley family being followed here.

    6. Hester Worley [Blount] dies between March 1740 and February 1745 in order for her minor children to be bonded over as orphans.

    7. Her children put up as orphans as alledged by Ancestory.com per Tyrrel County, North Carolina Guardian Bonds which lists a bond posted in the amount of 1,200 pounds for the orphans of John Worley of Tyrell County on February 4, 1745. Orphans were Thomas Worley, Sarah Worley, Ester (sic) Worley and John Worley. Bondsmen were "James Blount and Thos. Blount, Bondsmen included Blounts, speak strongly for them being the children of John and Esther. For these children to still be minors, their births would have need be ranged before 1724 which fits, though tightly, for a marriage date of 1718/9 between John Worley and Hester Blount born March 1703 at Mulberry Hill.

The pending logical fit for this John Worley to have fathered both the older family and the younger family would have to be such a pedigree as follows:

@ John Worley Treasure of Chowan 1723, Justice of the Peace, 
+ As a matter of chronological logistics, Joshua Worley was the only son named in his father John Worley's will. Also with John 
Worley marrying Mary long about 1712, as his first wife, this precludes any son named John before that date of 1712. A son John 
Worley of John Worley and Mary Long would not have been able to have married Hester Blount at age 10 or less to produce 6 (six) 
orphan children under the age of 21 by the 1744/45 orphan bond dates. He would have to have been born about 1700/1698 or so. Thus 
either John Worley and Mary Long's family needs to be moved back at least a full decade or that John Worley is not 
the son of John Worley and Mary Long and some other 'John Worley' or it was in fact the same John Worley who had 
an older family by Mary Long who also after her death bef. 1722, then married also as a second wife Hester Blount.
* While it is possibly likely that John Worley first married a Mary Long, it would appear that it is not that Mary Long said to be
born 26 Apr 1703 in Coventry, Tolland, Ct. of William Long and Mary Henbury. She was more likely that Mary Long born 1686 of Tyrrell, 
NC, daughter of James J. Long and Elizabeth Hawkins.
source: Orphan Bonds of the children of John Worley Jr., who was the husband of Hester Blount. The only question is, 'Was Hester Blount the second wife of John Worley Jr. or the first and only wife of John Worley Jr. Now the John Worley who married Mary Long was the son of another John Worley and his wife. So as a matter of fact there were at least three John Worleys and possibly four to give rise to the complication of who was John Worley Jr. and/or Sr., and just when and in relationship to whom. The simple point being here that John Worley who did mary Mary Long was a John Worley Jr. to his father John Worley. And then in turn as the passage of time and events would take place that John Worley Jr. who married Mary Long would have in turn come to be and have his turn at being John Worley Sr. in respect to his sone John Worley Jr. * Now as to the fact that John Worley in his will of 1740 does state his bequeths in the 'past tense' of haven 'gave' such items named in the will would well indicate that he may well have done just that. Prior to the date of the will which was an attempt to formalize those bestowals which had already been 'gave' and already had in hand of his older children. Now for why Hester who would have been living either as his second wife, the potential mother of John Worleys in turn 'Jr.' IN this respect one might tract down such property deeds of conveyance which may have so priorly past on those items of property named in his will. That the older children were concerned with making the point of what was theirs as have been priorly given them. As it were the legal law suits brought by the Blount's against the estate of John Worley and the handling of the said by the Hand of the executors of the will, Thomas Leary and Joshua. And this to the end that Joshua Worley has to buy that which was 'given' him in hs father's will an even Thomas Leary had to buty the negro slaves at the estate sale which had been willed Elizabeth in her father's will and likely already given her for her use even prior to that will. It would further seem that John Worley would have also provided for the children of his second family in some such similiar manner, the question is just what was it that Hester Blount Worley had been give as to an 'estate' for the care and welfare of his seond family. ** 1741 - Will of Thomas Norcum pf Perquimmans County mentions Mary Norcom, daughter of John Worley. (See ^^ note below.) ^ With consent of her guardian Joseph Blount, so as of 13 May 1749 Sarah Worley was not yet 21 ^^ At death of her father-in-law, Thomas Norcom (23 Apr. 1741), she is named as wife of Thoams' son Thomas Norcom and dec'd mother of that Thomas Norcom's son John Norcom (grandson of the Thomas Norcom 'her father-in-law). She is there said to be the daughter of John Worley. And she was alluded to by the mention of John Norcum grandson of John Worley in his will though 'Mary' by then also being deceased was not named therein by name.

1704-1716 1704- Deed - Chowan - John Worley - from George Slade, 3/21/1704-1705 "assignment of ye within Track of Land". 1707- John Worley in a suit with Mary Blount. [Chowan & Tyrrell County NC Records] 1714- Patent - Chowan - John Worley - 155 acres - being ye Beech Neck adjoining to ye Middle Neck swamp on ye South Shore of Chowan, joining ye swamp. 1715 July 18. Susannah Harrison, Alb, to Zachery Jurkin, letter of attorney to ack unto Captain John Worley a tract of land joining to ye land that was Thomas Cooper's. Wit: John Simpson, Henry Clark. Reg 10 Sept 1715. [Hofmann, Chowan Deeds #731, from Chowan DB AB #1, pg 152] same day Thomas Harrison and wife Susannah sold Worley 297 acres. [Hofmann, #732 & Chowan DB AB #1, 152.] 1716- William Fryly makes a return to this Court of these following Delinquents for not working on the Road: Mr. Lee, Jacob Blount, Captain Worley, Thomas Stealey, James Hooper, Thomas Wyley, Thomas Long, James Long and Eliz. Long. [Deed Book B #1, Chowan County, NC, #1658, pp. 17-18, 18 Apr 1716] 1716- Court - Chowan Precinct - Capt. John Worley criticized because he "keeps in his house the wife of John Hawkins, she having several children contrary to law." [John Hawkins appears to [be] the son of Thomas Hawkins and Elizabeth Blount. Elizabeth Blount was the sister of John Blount, who was the father of Esther Blount, wife of John Worley, Jr.] 1716- Court - Chowan Precinct - Capt. John Worley was to continue to be overseer of roads in lower district and Thomas Lee to be overseer of roads in the upper district. 1716-1717 1716- Court - Chowan Precinct - Capt. John Worley, Esq. - Thomas Lee is accused of maliciously committing false libel in writing to the defaming of Capt. Worley: "through his ignorance and spite to me (meaning the said Thomas Lee) I am like to be a great sufferer in many particulars for he (Worley) gives ill advice to my servants, and . . . " (is not doing his job properly with regard to debts collection). 1716- Court - Chowan Precinct - Capt. John Worley, Esq. - Thomas Lee pleads not guilty to charges of libel against Worley. Repeats his statements of before, and claims that Worley "kicked him" as he left Worley's house. 1716- Court - Chowan Precinct - Capt. John Worley, Esq. acknowledges that he keeps Mary Hawkins as "a hierling and no otherwise". [See above discussion of John Hawkins] 1716- Court - Chowan Precinct - John Worley appointed by the General Court as overseer of a highway to assure that all persons in the area are to work on the road. He was also an assistant justice. 1716- Court - Chowan Precinct - John Worley began an eight year period as a justice in general court. 1716- Court - Chowan Precinct - John Worley served as a Justice of the Peace. 1716- Court - Chowan Precinct - John Worley, Esq. - John Swain petitioned that his orphan sister, bound by the court to John Worley, Esq., may be taught to read by him. It was so ordered. 1717- Tax - Chowan - John Worley, Esq. - Taxpayer - 1900 acres. 1718-1721 1718- Council - Chowan C. H. - Capt. John Worley gave evidence of a "Villianous confederacy of Mr. Worseley's children to keep an Indian slave, Pompey, from the deserved punishment due him. Thomas Worseley was ordered to give bond of 500 pounds for Mary that he and daughter Mary attend next court. John Worseley, son of Thomas, to receive "39 lases well laid on his bare back." Pompey, the escaped Indian slave, is wanted dead or alive. 1718- Patent - Chowan - John Worley - 640 acres in Chowan Precinct on South side of Morratock River, joining William Mitchell and the Beaver Dam Branch. 1720- Court - Chowan Precinct - John Worley collected fines from 2 men charged with "swearing, etc.". 1720- Patent - _?_ - Captain John Worley - 150 acres on the east side of Broad Creek on the Neuse River, joining the Mouth of a Gut above the Indian Graves, a Small Gut, and the said creek which land was formerly surveyed for Dudley Gordon and by him elapsed. 1720- Deed - Feb. 8 - William S. Steeley and Mary D. Steeley sell to Jno Worley 150 acres for 20 pounds. All parties "of the County of Albemarle and Precinct of Chowan in North Carolina." Deed 'acknowledged' on March 29, 1721. 1720- Deed - Feb. 8 - "Jno Worley of the County of Albemarle precinct of Chowan in North Carolina Esq" sell to "Will Steely" 50 acres for 20 pounds. Deed 'acknowledged' on March 29, 1721. 1721- John Worleys tax list. [present Washington County, NC] Zachery Girkins 60 acres land 0:1:0 tax [Haun, #337, Old Albemarle County North Carolina Miscellaneous Records 1678 to ca 1737] this is 60 acres his father-in-law, Nathaniel Everett, gave him in 1718, part of Persimmons Neck in the fork of Haw Branch, East side of Conaby Creek. 1722-1727 1722- Patent - Chowan - John Worley - 476 acres in Chowan Precinct on the south side of Albemarle Sound, joining Thomas Steely, Middle Neck Swamp, Beech Neck Swamp, the long Branch, James Hooper, Haw Branch and the said sound. 1723- Court - Chowan Precinct - John Worley - Petition of John Worley for 220 acres in Chowan to be granted him by a lapse patent. 1724- Court - Chowan Precinct - John Worley served as a Solicitor General. 1724- Council - Edenton - John Worley on grand jury of Gen. Court in Edenton. 1726- Court - Chowan Precinct - John Worley served as Foreman of the Grand Jury of the General Court. 1726- Court - Chowan Precinct - John Worley - Edmond Porter claims he was assaulted in one of the public streets of Edenton by John Worley and other government officials. But it was the opinion of the court that Porter was the aggressor. 1726- Court - Chowan Precinct - John Worley, Esq. was nominated by Governor Everard to be a member of the Council at Edenton. 1727- Court - Chowan Precinct - Coll. Worley was paid "to the Ballance of Coll. Worley account by order of the Council 49 pounds." 1727-1728 1727- Court - Chowan Precinct - Collo. John Worley brought suit against estate of Tunis Vangelder for not paying a debt Worley was owed. 1727- Court - Chowan Precinct - John Worley - Edmond Porter, of Chowan Precinct, "moved by the Devill, made Seditious Speeches and menacing behavior", shook his fist at the governor, Sir Richard Everard, and called him a worthless fellow, threatened a revolt and defamed John Worley, Foreman of the Grand Jury. 1727- Court - Chowan Precinct - John Worley - A John Miles of Edenton was charged with armed robbery of 2 gallons of rum valued at 10 shillings. Pleaded guilty but could only pay 12 pence. John Worley came into court and paid the costs due as well as promising to pay 15 pounds Miles owed to provide "meat, drink, lodging, and apparel" for 3 years. Miles agreed to serve Worley for the 3 years. 1727- Court - Edenton - John Worley - The court presented an indictment against John Worley and his son Joshua for an "assault made by them on the body of Capt. Thomas Bell." 1727- Court - Edenton - John Worley - The Attorney General came to prosecute the case against Worley and son. The Worley's were absent. Writt of Alias Capias. 1727- Court - Edenton - Joshua Worley, son of John Worley who, along with his father, was sued by Thomas Bell for assault. 1727- Patent - Bertie - John Worley - Lords Proprietors to Robert Forster. 1728- Court - Edenton - John Worley and son Joshua paid costs for assault and were discharged along with others whose cases had "layne before the Genl. Court for a considerable time". 1728-1729 1728- Court - Chowan Precinct - John Worley - Court issued a bill of indictment against Thomas Bell for libel against John Worley and others. Dismissed for lack of evidence. 1728- Letter - Edenton - John Worley helped write a letter to the King of England expressing displeasure with Governor Everard. 12/12/1728. 1728- Patent - Bertie - John Worley - Lords Proprietors to Samuel Swann, a grant for 3200 acres at head of Fishing Creek adjoining Robert Forster. Signed by seven people, including J. Worley. 1728- John Lord Cartert, Palatine, and the rest of the true and absolute Lords Proprietors of Caolina... for and in consideration of the sum of Four Hundred pounds in hand and paid to our Receiver General.... grant to... the Honble Colonel William Byrd, of Va. 20,000 acres in Albemarle Co. on the Bounds of Va. beginning at Sugar Tree on the Va. Line a little below Sable Creek running thence along the Va. George Burrington appointing John and others to Justice of General Court. 10/6/1732. 1733- Deed - July 28 - William Stealy sells to John Worley land "including that fifty acors which the said William Steely had of ye said John Worley and with ten acors more which includes all the old Plantation of ye said William Steelys..." for thirteen pounds. Deed proved on December 11, 1740 1735- Deed - Edenton - John Worley and others signed a blank patent for granting of 640 acres. 10/28/1735. 1738- 22 August 1738. List of Orphans as of 1745, according to dates Lovick/Lovel would be age 26 Mary would be age 24 Thomas would be age 23 Sarah would be age 20 Ester would be age 18 John would be age 15 This yields three above the age of 21, not requiring Orphan Guardianships though they are listed as such. And Sarah who married John Luten in 1749 at would be age of 24 still had to have her guardian Joseph Blount's permission? NOT. Where does the exact day of 17 Jan come from of 1718/19 of that marriage? That date 17 Jan 1718 would mean a marriage of Hester at age 14, not quite 15 or if 1719, 15 not quite 16. Not impossible but likely? NOT Thus the faulty logic here is that the 6 children subject to the orphan and guardian bonds of 1744/5, would have to have been born later than 1724 or else they are not subject to guardian bonding but free to use their estate as they will.
