In the Name of God Amen I Thomas Hender of Tregenna in the Parish of Alternon in the County of Cornwall Yeoman being weak in Body but of Sound and disposing mind memory and understanding (praised be God for the Same) Do make publish and Declare this writing to be and contain my last Will and Testament in manner and form follwing First I Commend my Soul into the hands of Almighty God my Creator hoping for a remission of All my Sins by the Merits and Mediation of my Saviour Jesus Christ and my Body I Commit to the Earth to be decently interred at the Discretion of my Executrix and Executors In Trust hereinafter named And as to all my worldly Estate both real and personal

I Give Devise and bequeath the same as hereinafter mentioned Whereas my Wife Sarah is already provided for by a Settlement made on her Marriage with me of all that Messuage Tenement and Premisses commonly called or known by the Name of Lower Tregenna Situate lying and being in the said Parish of Alternon which after her Decease will descend to my Son Thomas And all that my other Messuage Tenement and Premises in or called Higher Tregenna in the said Parish of Alternon will immediately after my Decease likewise descend to my said Son Thomas(R)

I Give Devise and Bequeath unto my said Son Thomas Hender when and so soon as he shall attain his Age of Twenty one years All that my Freehold Messuage Tenement and Premisses with all and Singular the priviledges and appurtenances thereunto belonging commonly called or known by the Name of Coombes Tregenna Situate lying and being in the parish of Alternon aforesaid To have and to hold the said last mentioned Messuage Tenement and Premises with the Appurtenaces called Coombes Tregenna unto my said Son Thomas Hender his Heirs and Assigns forever Subject nevertheless to the payment of One Annuity yearly Rent Charge or sum of Forty Shillings issuing and payable out of the same premises to Elizabeth Venning* of the said Parish of Alternon during her life and which is already charged thereof And also Subject nevertheless to and charged and chargeable with the payment of the several Legacies or sums of Money following (that is to say)

To my Son John Hender the Sum of one hundred Pounds,

To my Son William Hender the like Sum of one hundred Pounds,

To my Daughter Elizabeth the Sum of Fifty Pounds

To my Daughter Mary the like Sum of Fifty Pounds and

To my Daughter Grace the like sum of Fifty Pounds all of lawful Money of Great Britain which I direct shall be paid to them respectively when and as they shall severally Attain their Ages of Twenty one Years

And in Case my said Son Thomas Hender shall happen to die before he shall Attain the said Age of Twenty one Years Then I give Devise and Bequeath my said Estate called Coombes Tregenna unto my said Son John Hender his Heirs and Assigns forever Subject nevertheless to the payment of the said Annuity of Forty shillings a year to the said Elizabeth Venning as aforesaid And also Subject to the payment of the several Legacies--

aforesaid to his Brother William Hender and his said Three Sisters And in the Case the said Legacy of One hundred Pounds so bequeathed to by said Son John I will and direct shall be paid as follows, The Sum of Fifty Pounds part thereof to my said Son William And the Sum of Fifty Pounds other part thereof to and amongst my said three Daughters or the Survivors or Sruvivor of them equally between them Share and Share alike when and as they shall severally Attain their respective Ages of Twenty one Years And in Case my said Son John Hender shall happen to die before he shall Attain his said Age of Twenty one Years Then I give and devise the same Estate called Coombes Tregenna unto my said Son William Hender his Heirs and Assigns forever Subject nevertheless to the payment of the said Annuity of Forty Shillings a year to the said Elizaberh Venning as aforesaid And also Subject to the payment of the said Legacies to my said Three daughters And in that Case the said Legacies of One hundred Pounds each so bequeathed to my said Sons John and William I direct shall be equally paid and divided to and amongst my said three Daughters or the Survivors or Survivor of them as they shall Attain their said several Ages of Twenty one Years And if my said Son William shall happen to die before he shall Attain his said Age of Twenty one Years Then I Give and Devise my said Estate called Coombes Tregenna unto my said three Daughters together with all the Legacies to my said Sons as aforesaid when and as they shall severally Attain their said Ages of Twenty one Years equally between them share and share alike to take as Tenants in Common and not as Jointenant And to their respective Heirs and Assigns forever And in Case either of my said Daughters shall happen to die before She Attains her said Age of Twenty one Years

Then I Give and Devise the share or shares of her or them so dying unto the Survivors or Survivor of them her or their Heirs and Assigns forever Also I Give and Bequeath unto my said Wife Sarah And to my Brother William Hender of Alternon aforesaid and Thomas Vosper of Lewannick in the County of Cornwall Yeoman All my Goods and Chattles both Quick and Dead for the purpose of paying off and discharging all my just Debts and Funeral Expences (Except my Household Furniture) And also Except all that my Leasehold Estate called Captains Ground Situate lying and being in the parish of Alternon aforesaid Which said Estate I hereby Give and Bequeath unto my said Son Thomas Hender his Executors Administrators and Assigns when he shall Attain his said Age of Twenty one Years for and during all my Estate and Interest therein And if my said Goods and Chattles shall prove insufficient to pay my said Debts and funeral Expences I hereby will and direct that my Said Leasehold Estate called Captains Ground shall be sold to make good such Deficiency And Thereby Authorize and impower my Trustees and Executors in Trust to Sell the same for the purpose aforesaid And my further will is and I hereby direct that the Rents and profits of my said Estate called Higher Tregenna and my said Estate called Lower Tregenna so under Jointure as aforesaid (if my said Wife shall die before by said Son Thomas shall Attain his said Age of Twenty one Years) shall be applied in the first place toward the--

Maintenance and Education of my said Son Thomas untill he shall Attain his age of Twenty one Years as aforesaid and the Overplus thereof (if any) shall be applied towards the payment of the Legacies to my other Children as they or either of them shall Attain their said Ages of Twenty one Years And I further will and direct that the Rents and profits of my other Estate called Coombes Tregenna and my said Leasehold Estate called Captains Ground during my Interest therein Case the same should not be sold And the overplus (if any) of the said Goods and Chattles after payment of my just Debts and Funeral Expences as aforesaid shall be applied towards the Maintenance Education and binding out apprentices of all my six Children until they shall severally Attain their ages of Twenty one Years as aforesaid Also I give unto my said Wife the use of all my Household Furniture untill my said Son Thomas shall Attain his said age of Twenty one Years if she shall so long continue a Widow and as soon as my said Son Thomas shall Attain that Age I direct that the same shall be equally divided, The use of one Moiety thereof I give unto my said Wife during her Life or Widowhood as aforesaid and the other Moiety thereof I give and bequeath unto my said Son Thomas his Executors Administrators and Assigns And after the Decease or Marriage again of my said Wife I give and bequeath the said Moiety of the said Household Furniture unto my said Son Thomas his Executors Administrators and Assigns And I do hereby Nominate Constitute and Appoint my said Son Thomas Hender Executor of this my Will and I likewise appoint my said Wife Sarah and the said William Hender and Thomas Vosper Executrix and Executors In Trust of this my said Will And I do hereby Devise the Guardianship Care and Education of all my said Children during their Minorities as aforesaid unto my said Wife Sarah and the said William Hender and Thomas Vosper and the Survivors and Survivor of them But it is my Will and Desire that the Guardianship of my said Wife shall cease on her Marriage and ceasing to remain my Widow Provided and my Will is That my said Trustees and Executrix and Executors in Trust hereinbefore named and the Survivors and Survivor of them And the Executors and Administrators of such Survivor shall any may at all times in the first place reimburse themselves herself and himself respectively out of the said Trust premises respectively all such Costs Charges Damages and Expences as they or either of them shall or may at any Time Expend layout and be put unto for or by reason or means of them shall be Answerable for any loss which may happen to any of the Trust Premises Unless such loss happen through his her or their wilful neglect or Default Nor one for the other or others of them Nor for more Monies than shall actually come to his her or their Hands respectively but each and --

Everyone of them for his her and their own Acts receipts neglects and Defaults only In Witness whereof I the said Thomas Hender the Testator have to this my last Will and Testament contained in four Sheets of paper, set my Hand at the bottom of each of the three preceding sheets and my Hand and Seal to this fourth and last sheet this Fourth day of May in the Year of our Lord one thousand seven hundred and Ninety One --

The before Written Will of the before Named Thomas Hender Deced was proved in Common form 25th April 1794 Before the Rev. Mr. John Pomeroy Clk Batchelor of Arts, Surrogate & so forth And Admion of all and singular the Goods & so forth of the Said Deced & all things howsoever Concerning his said Will was Granted to the three Executors in Trust & Guardians therein named being first in due form of Law Sworn Saving & so forth-

* [NOTE: The 'Elizabeth Venning' in this will is not Thomas Hender's sister Elizabeth, who according to her last will and testament of 1880/81 was a spinster. Nor could it be his own daughter, for she is only age about 14 and not married at the time of his written will. It is likely his Aunt Elizabeth Venning nee Hender, daughter of Thomas Hender and Elizabeth Northy, who married John Venning. It would seem that Thomas is providing for his long lived 'aunt' or perhaps a cousin. But this is not for sure so she is displayed in green.]
