There Are TOMS in the House [Ancestors
of Selina Toms, wife of William Hender]
There are two Hender siblings of Thomas Rowe Hender and Marianna
Trout who married TOMS. My second great aunt Ellen Hender Married a James
TOMS and my second great uncle William Hender married a Selina TOMS. I will
begin with what I currently know and that is somewhat of the ancestry of the
family of Selina TOMS who married William HENDER. The James TOMS family of
Ellen Hender will be seen on a TOMS 2 page. Some
have confused the Francis TOMS Mariner and Fisherman, born about 1796 of
the Talland/West Looe area with the Francis TOMS Fisherman born about 1785/6
of the East Looe area. They are NOT the same so be sure of the actual decade
of birth and the area in which each of these two different Francis TOMS
reside. According to the 'Rewet Pedigree' they both do fold back into the
TOMS family which descends from
Richard Rewet of
about 1400. And if the 'James Roberts TOMS' of the Wesleyan Curcuit
is claimed by one or the other it is of little matter for is he is the son
of the Talland Francis TOMS family then there simply is another James TOMS
who does descend from the Francis TOMS family of East Looe. And they are
both distantly related and both are further descended from Rewet. For now,
on with the Francis TOMS' family whose Selina TOMS married William HENDER.

From various additional information, including the following will of Richard
Keast, it is determined that the wife of Francis Toms is Mary Keast, the
daughter of Richard Keast and his wife Ann.
The Will of Richard Keast of Polperro, Parish of Talland, 1834
In the Name of God Amen I Richard Keast of Polperro in the County of Cornwall Grocer being of sound mind
do constitute these presents to be my last Will and testament first I commend my soul to God through the
events and mediation of his son Jesus Christ and my body be buried in Christian burial and as to my worldly
Estate and Effects I give and bequeath unto Henry Rickard of the town of Polperro Carpenter and to Joseph
Andrew of Trevidock in the parish of Lansallos Carpenter In trust for all my right and interest in leasehold
Estate at Well Close or Wellcove in the parish of Antony and all my right and interest in certain houses at
well close or well cove in the said parish of Antony Also all my right and interest in a leasehold house in King
Street Devonport and also all my right and interest in a leasehold house in Canon Street Devonport all my
right and interest in the Market house and house over the said Market house in Polperro and also my stock
in trade Cash, securities for money and all debts which shall be owne to me at my death And I do ordain and
bequeath all this my property herein before mentioned unto the said Henry Rickard and Joseph Andrew and
the survivor of them In trust as hereinafter mentioned and in manner hereinafter expressed first they the
said trustees Henry Rickard and Joseph Andrew shall pay to my wife Ann Keast the sum of sixteen pounds
per year at the Rate of Eight pounds per half year during her natural life and I further order devise and
appoint that if certain individuals shall die on whose lives portions of the property hereinbefore named is
held by me and the sums in which such lives are insured by me with the West of England Insurance Company
are consequently paid then the money thus arising the said trustees Henry Rickard and Joseph Andrew and
the survivor of them shall place in the Devonport Savings Bank And all other monies which may from time to
time be received by the said trustees more than sufficient to pay to my wife Ann Keast the said yearly
income of sixteen pounds and the premiums of the Insurances hereinbefore stated they the said trustees
shall place in the Devonport Savings bank as aforesaid And I order and bequeath at the death of my said wife
Ann Keast all such of the property in houses estates or money as shall be in possession of the said trustees
Henry Rickard and Joseph Andrew be equally divided between my two Daughters Mary Toms the wife of
Francis Toms and Elizabeth Bate the wife of Henry Bate shall and share alike for their own use and benefit I
give and bequeath to Ann Keast my said wife all my right and interest in a house situated near the piers in
Polperro in the Parish of Lansallos to be by her possessed and enjoyed during her natural life and of which
she shall have possession at my death and after the death of my said wife Ann Keast I give and bequeath the
said house near the piers in Polperro aforesaid if the lives on the said house or any of them be then alive to
my two daughters the said Mary Toms wife of Francis Toms and Elizabeth Bate wife of Henry Bate in equal
parts share and share alike also I give and bequeath unto my daughter Mary Toms wife of Francis Toms all
my right and interest in and share of the Sloop or Barge called the Mary the said Mary Toms wife of Francis
Toms paying annually the sum of five pounds to the said trustees Henry Rickard and Joseph Andrew And I
also give and bequeath unto my said daughter Elizabeth Bate the wife of Henry Bate all my right and interest
in and share of the Schooner called the Provideure she the said Elizabeth Bate paying annually the sum of
two pounds ten shillings to the said trustees Henry Rickard and Joseph Andrew And I order and ordain that
the said sums of five pounds and two pounds ten shillings which shall as aforesaid be paid to the said
trustees Henry Rickard and Joseph Andrew And I order and ordaine that the said sums of five pounds and
two pounds ten shillings which shall as aforesaid be paid to the said trustees Henry Rickard and Joseph
Andrew and the survivor of them by the said Mary Toms and Elizabeth Bate my daughters shall be paid
during the life of my said wife Ann Keast and at her death cease and determine And the said sums of five
pounds and two pounds ten shillings shall be paid to the said trustees at least one month in every year
before the time when the Policies of Insurance hereinbefore mentioned become due in order that the said
trustees may pay the premiums on such Policies of Insurance aforesaid I give unto Elizabeth Bate my said
Daughter my Clock to be by her possessed at my death I also give and bequeath our half of my household
furniture and books to the said Ann Keast my wife to be by her possessed at my death I also give and
bequeath the other half of my household furniture and books to my two daughters the said Mary Toms and
Elizabeth Bate in equal parts share and share alike And I also order and ordain that should either or both of
my said Daughters Mary Toms and Elizabeth Bate die during the life time of my said wife that the respective
part parts share or shares of my said daughters shall go to and be the property of the Children of my said
daughters in equal parts the Children of each of my said daughters dvoiding their respective mothers share
or shares of the property hereby devised and bequeathed And I also ordain that the said division of my
household furniture and boos shall be made by the said trustees hereinbefore named but if any dispute arise
concerning the division then such dispute shall be determined at the discretion of the said trustees I give and
bequeath all my wearing apparel to Henry Bate and Francis Toms my sons in law in equal parts The trustees
to pay funeral Expenses the proviso this my Will and all my Debts And I do hereby ordain and constitute the
said Henry Rickard of Polperro and Joseph Andrew of Treviddick in the parish of Lansallos both in the County
of Cornwall to be the Executors of this my last Will and testament revoking all other Wills or Will made
heretofore In Witnes whereof I the said Richard Keast the testator have to this my last Will and Testament
contained in these sheets of paper to first and second sheets set my hand and to the second and last sheet
set my hand and seal this twenty seventh day of December one thousand eight hundred and thirty four

A Codicil to this my last Will and testament made this twenty ninth day of May 1837 I do hereby order
devise and appoint that if the lives on which my property hereby devised to my wife should die and the
money consequently paid from the West of England Insurance Office or from other sources in the savings
Bank aforesaid should yield to my said Wife a less income than is appointed for her in this my last Will and
Testament in that case that she shall be at liberty to take I do herby bequeath to her so much money yearly
from the sum or capital there deposited as shall amount to the full sum or income given to her in this my last
Will and Testament to be drawn or received by her in like manner as is specified in this my last Will that is to
say every six months payable at the commencement of each of such periods I do order and appoint that this
shall be taken as a part of my last Will aforesaid witnesses Jonathan Couch Priscilla Bendle – Richard Keast
Another Codicil I do hereby further order and appoint desire and bequeath unto my said wife that instead of
the annuity of sixteen pounds as given to her in my said last Will and Testament she shall receive the sum of
twenty pounds payable to two half yearly sums of ten pounds in the manner described and ordered in my
last Will and Testament and that if the other property specified in this my last Will and Testament be not
sufficient to produce so much then what is deficient of it shall be made up from the profits of the Vessels or
either of them mentioned within so long as my said wife shall live
Appeared Personally Jonathan Couch of Polperro in the Parish of Lansallos in the County of Cornwall
Surgeon Edward Hocken of the said Parish of Lansallos Farmer Elizabeth Bate wife of Henry Bate of Polperro
aforesaid and Mary Toms wife of Francis Toms of Love in the said County and jointly and severally made
oath as follows And first the said Jonathan Couch for himself made oath that he knew and was well
acquainted with Richard Keast late of Polperro in the parish of Talland in the County of Cornwall Shopkeeper
deceased and attended him as his Apothecary for several years before and to the time of his oath which
happened on the fifth day of June last and that he was on the thirtieth day of May last at the house of the
said Deceased situate at Polperro aforesd. And in the room thereof in which de the said Deceased was there
lying ill in bed and that in the course of conversation with him this Deponent Jonathan Couch he the said
deceased expressed his wish to increase the annuity of sixteen pounds he has by his will left to his wife to
the sum of twenty pounds payable and the deficiency if any to be supplied as in the writing hereinafter
mentioned is expressed desiring him the Deponent to write a Codicil to that effect on his said Will which will
the said Deceased then gave to him the Deponent for such purpose and that the Deponent accordingly
thereupon immediately wrote the writing now appearing on the last of the sheets of paper hereto annexed
on which the said Will of the said Deceased with a Codicil thereto are also written the said writing beginning
thus “Another Codicil I do hereby further order and appoint devise and bequeath unto my said wife that
instead of the annuity of sixteen pounds as given to her in my said last Will and testament she shall receive
the sum of twenty pounds” and ending thus “then what is deficient of it shall be made up from the profits of
the vessels or either of them mentioned and then so long as my wife shall live” And the further made oath
that immediately after he the Deponent has so written the said writing and before there could be time for
the same to be read over to the said Deceased or for him to sign or make his mark thereto he the said
Deceased became so much worse in body as to be unable to attend to the reading thereof or so to sign or
make his mark thereto and that in Consequence the said writing was not read over to the said Deceased
contained in such state of incapacity until his death And the said Edward Hocken and Elizabeth Bate for
themselves made oath that they were present with the said Deceased at his house situate at Polperro
aforesaid and in the room thereof in which he was lying ill in bed on the said thirtieth day of May and heard
the said Deceased as deposed to by their fellow Deponent the said Jonathan Couch express in conversation
his wish and desire that the annuity to his wife should be increased to twenty pounds and otherwise as
deposed to by their fellow Deponent the said Jonathan Couch and his desire that the said Jonathan Couch
should write a Codicil to this Will to that effect and that the said writing contains the substance of what (and
as nearly as can be remembered the very words the said Richard Keast requested the said Jonathan Couch to
write for him as a further Codicil to his said Will now appearing on the last of the sheets of paper containing
the said Will and the first Codicil thereto and they further made oath that as is deposed to by the said
Jonathan Couch the said Deceased immediately afterwards and before there could be time for the same to
be read over to him or for him to sign or make his mark to the said writing became so much worse as to be
unable to attend to the reading thereof or to sign or make his mark thereto and that he continued in such
state of incapacity until his death And all these deponents further made oath that the said Deceased at and
during the time now deposed of and until he became too ill to execute the said writing as a Codicil to this
Will and in which state he contained till his death was of perfect sound mind memory and understanding
talked and discoursed rationally and sensibly and well knew and understood what he said and did and what
was said and done in his presence And they further made oath that had it not been for the said Deceased’s
becoming worse as before deposed to they verily believe the said Deceased would have proceeded to
execute the said writing as Codicil to his Will by subscribing his name or affixing his mark thereto and the
said Elizabeth Bate for herself further made oath and the said Mary Toms for herself made oath that they
are the natural and lawful and only Children of the said Deceased and the Legatees respectively of two
certain Vessels mentioned in the last Will and Testament of the said Deceased and that they are by and with
the approbation of their respective husbands consenting that the said writing in respect to which the said
Jonathan Couch Edward Hocken and she the Deponent Elizabeth Bate have herein deposed should be
proved as a second Codicil to the said last Will and Testament of the said Deceased – Jonathan Couch –
Elizabeth Bate – Edward Hocken – Mary Toms – On the 21st day of August one thousand eight hundred and
thirty seven the said Jonathan Couch Edward Hocken Elizabeth Bate and Mary Toms were by virtue of the
Comon. hereto annexed duly in proove to the truth of this affidavit Before me William Rawlings rector of
Lansallos Cornwall 1837 Commonr.

Proved at London with two Codicils 23rd Jan. 1838 before the Judge by the oaths of Henry Rickard and joseph
Andrew the Exors to whom admon was granted having been first sworn by Comon duly to admr. Elizabeth
Bate (wife of Henry Bate) and Mary Toms (wife of Francis Toms) the daughters and the only persons whose
interests are affected by the second Codicil having first consented as by acts of Court appear.

As is, this is most likely the same family with minor age adjustments
and places of birth, like were you born in Sugar House or Salt Lake? So the
Lansallos/Talland is more like a differnce in 'Parish' of Talland and
village, corner or street of Lansallos. The parents with the wife's age
wandering a bit and the two daughters Philipa and Sophia are present in all
three census decades. John wasn't home for the second census. And the older
siblings made only the first census at home in 1841.
Thus having established the family from the census records available, the
church records can help to flesh it out a bit.

(This could be a missed son James Robert TOMS, it is a squeeze to fit him in but do-able.
Also the 'other' Francis and Mary TOMS family pedigrees also like to claim him as his dates
fit their James TOMS. So either he is a member of this Francis TOMS and Mary KEAST family or
he is likely the James TOMS the census records show for the other Francis TOMS and Mary
STIVEY family. Now the second son named Thomas does solve why the 1841 census age date of
being Talland baptism on 6 December 1829. Simply the first Thomas dies before the second
'Thomas' is born and there are two sons named Thomas which works. As for Selena, her
circuit born and baptism dates work with her census dates and give one reason why she
was not Talland baptized as were the other children.)
Philippa TOMS Note: have not found parish baptisms for John TOMS or Sophia TOMS
cb 21 Feb 1836 Also: There is a burial date for a Selina TOMS of 8 Jun 1855, Talland
at age 22 and with her residence then at East Looe-could be.
After putting out the all this 'raw data' from census and church records, and with referencing
various online pedigrees; using some logic and reasoning a family for this Francis TOMS and
wife Mary KEAST can be structured as follows:

(Regardless of whether 'James Roberts TOMS' is of this family or the East Looe Francis TOMS and
Mary STIVEY family it still remains as proven by census and many other sources that there is
still a son James TOMS of the East Looe family who in point of fact marries Susanna Pengelley
and they have another son of that James TOMS who marries Ellen Hender, William Hender's sister.

William [Keast] TOMS
Before we get into the family of William TOMS and Maria sTEPHENS,
there is the question of the middle name of 'Keast'. William Keast Toms was Christened/baptism 6 December
1829 at Talland which is also the same Christian baptism date for Thomas Toms, both sons of Francis Toms
and his wife Mary of Polperro. Both baptism were at the Parish of Talland. By a certificate of Revd Evans,
William Keast Toms was privately baptized and apparently Thomas Toms was not. Thus begs the question, 'What
could account for one son of Francis and Mary Toms being 'privately baptized' and the other one not. Well a
likely guess would be that the Church of England performs infant baptisms regularly and Thomas Toms was an
Infant. And it William [Keast] Toms was actually born about 1826, as indicated by various census records,
then he would have been 3 years old or so and no longer an infant. And this may account for both the birth
date of about 1826, the Christian bapism date of 6 December 1829 and the fact that William Keast Toms'
baptism had appeared by certificate of Revd Evans. Given that likelihood we'll not proceed with the family of
Willian [Keast] TOMS and Maria STEPHENS.
Maria STEPHENS was the daughter of William STEPHENS and a Minor, meaning she was less than 21, when she
was married on 12 June 1856 at Talland to William TOMS. She was likely William's second wife as on the parish
record it states that he was a widower. William was likely age 30 having been born about 1826. And that is
the age which the 1861 census record confirms which is the first record where William, Maria and their
initially young family first appear together as follows:

Note that there is no children from a previous marriage living with them. All 3 children fit in since the
date of marriage in 1856, being 1857, 1859 and 1861. It is Selina and her age and place of birth that we
will be interested in. But for now we'll proceed to put the family of William [Keast] TOMS and Maria STEPHENS
into a pedigree tree with stated source references.
Family of William [Keast] TOMS and Maria STEPHENS
William [Keast] TOMS was born about 1836 and not Christian baptized until
about the age of three when it was done as a private baptism by Rev. Evens
according to the notes on his parish baptism record. He was first married
to unknown but as a widower he marries Maria STEPHENS a minor aged spinster
the daughter of William STEPHENS.
