EDWARD MOON WILL

Edward MOON (4th Great Uncle) b. abt 1793 - of Treheer in Liskeard, Cornwall, England Married: Peggy SOBEY (In Law) Died 12 August 1849 Will Dated: 3 January 1850 (written-20 January 1848) Parents: Nicholas MOON and Mary Ann


This is the last Will and Testament of me Edward Moon of Treheer in the Parish of Liskeard in the County of Cornwall Gentleman

I give devise and bequeath All my Messuages Lands Tenements and Hereditaments called Great Treheer Little Treheer and Reed a Mill in the parish of Liskeard aforesaid and all other my real and personal Estate whatsoever to which I shall be entitled at the time of my decease unto my brothers Nicholas Moon and Cornelius Moon their heirs executors administrators and assigns according to the several tenures and nature thereof respectively and Tenants in common and not as joint tenants subject nevertheless and except as hereinafter is mentioned

I give and bequeath to my dear Wife Peggy Moon the sum of Six hundred Pounds in addition to the settlement made on her at the time of our Marriage the same to be paid her by my Executors herteinafter named in manner following that is to say one hundred Pounds part thereof immediately on my death and the sum of Five hundred Pounds remaining part thereof at the experation of Twelve Calender months next after my decease and I hereby charge and make liable all my Lands so divided to my said brothers as aforesaid with the due payment thereof. I also give and bequeath unto my said Wife all the furniture pictures watch plate linen china glass and all other the houshold goods (except the clock in my dwelling house at Treheer aforesaid. I also give to my said Wife the sole and entire use and enjoyment of the said Dwelling House with the orices and Gardens thereto belonging for the space of Three Calender months next after my decease.

I give and bequeath to my Sister Mary Ann Snell of Little Treheer aforesaid the sum of five hundred Pounds to be paid to her by my Executors hereinafter named at the expiration of Twelve Calender nomths next after my decease.

I give and bequeath to Edmund/Edwd Moon Snell, William Snell and James Snell Sons of my said Sister Mary Ann Snell the sum of one hundred Pounds each to be paid to them respectively by my Executors at the experation of Twelve Calender months next after my decease

I give and beequeath unto Susan Trout and Jane Trout daughters of my late sister Susan the sum of Two hundred pounds each to be paid to them respectively by my Executors at the expiration of Twelve calender months next after my decease And I hereby charge and make liable all my Lands so devised to my said brothers as aforesaid with the due payment of the said several Legacies hereinbefore respectively given and bequeathed And I declare that the said Lagacies of Two hundred Pounds each so given to my nieces Susan and Jane Trout shall be in addition to the money to which they are entitled under their Mothers Marriage Settlement.

I give and bequeath unto Susan, Charlotte, Jane, Fanny, and George, Children of my sister Jane the Wife of George Raby the sum of Twenty pounds each to be paid to them respectively by my Executors at the expiration of Twelve Calender months next after my decease

I give and bequeath unto Christian Veale and Mary Ann Veale daughters of William Veale of the parish of Maker in the said County Gentleman the sum of ten pounds each to be paid to them respectivfely by my Executors at the expiration of Twelve months next after my decease

I give and bequeath unto Mary Welshman my servant the sum of Ten pounds to be paid to her by my executors at the expiration of Twelve Calender months next after my decease

I give and bequeath unto my workmen William Dumble, John Loudy, Richard Honey (Limeburner) and Thomas Richard the sum of Two pounds each as small tokens of my remembrance of them, the said several sums to be paid to them respectively by my Executors at the expirationm of one Calender month next after my decease

I give and bequeath to John Carswell the younger of the parish of Liskeard aforesaid Gentleman his executors and administrators

one annuity clear yearly rent charge or annual sum of ten pounds to be issuing and payable out of my Estate called Great Treheer in the parish of Liskeard aforesaid during the natural life of Mary daughter of my said sister Susan Trout and now the Wife of Thomas Hender the same to be paid to the said John Carswell his executors or administrators by equal half yearly payments the first payment thereof to become due and be made at the end of six Calender months next after my decease In Trust nevertheless for the said Mary the Wife of the said Thomas Hender and to be paid to her by the said John Carswell his executors or administrators free from the debts control or interference of her present or any future husband and I declare that her receipt alone shall notwithstanding covertion be an effectual discharge for the same

And I hereby direct and declare that the said John Carswell his executors and administrators shall have the same or the like remedy by distress for raising and recovering the said Annuity or yearly rent charge as Landlords have for the recovery of rent in arrear upon common leases And I further declare that the said Annuity so given for the benefit of my niece Mary Hender as aforesaid shall be in addition to the money which she has received under her mothers Marriage settlement.

I give and bequeath all the legal interests which shall at my decease be vested in me as Trustee or Mortgagee in any real or personal Estate unto and to the use of my brothers the said Nicholas Moon and Cornelius Moon and the survivor of them and the heirs executors adminitrators and assigns of such survivor upon such trusts and subject to such Equities as shall be subsisting therein respectively

And I hereby appoint my said brothers Nicholas Moon and Cornelius Moon Executors and residuary devisees of this my Will hereby revokeing all the other testamentary writings by me at any time heretofore made in witness whereof I have hereunder set my hand and

I have also set by hand to each of the three preceeding sheets of this my Will this Twentieth day of January in the year of our Lord one thousand eight hundred and forty eight

Signed by the said Edward Moon the Teatator as and last Will and Testament in the presence of us present at the same time who at his request and in his presence and in the presence of each other have hereunto subscribed our names as witnesses

Proved in common form the 3rd day of January 1850 before John Wallis A M Official etc. And Admion of all and singular the Goods etc of the said deceased and any way concerning the said Will was granted to Cornelius Moon the Brother of the said Deceased & one of the Executors named in the said Will Nicholas Moon the other Executor died in the live time of the Testator.
