This is the last Will and Testament of me Nicholas Moon of Treheer in the Parish of Liskeard in the County of Cornwall Gentleman

I give and bequeath unto my dear Wife Mary Ann Moon an annuity or clear yearly Sum of Ten Pounds clear of all manner of deductions whatsoever to be issuing and payable out of my Estate called Great Treheer in the Parish of Liskeard the same annuity to be paid to her my said Wife or Assigns for her own use and benefit during the term of her natural Life by equal guarterly payments to commence and begin from the day of my decease in increase and augmentation of the Provision made for her by the Settlement made in my Marriage And I do hereby charge and make liable my said estate called Great Treheer with the payment of the same annuity of Ten Pounds to my said Wife and in case any quarterly payment of the said annuity of Tenn Pounds or any part thereof share be in arrears twenty one days after the same shall be payable as aforesaid, Then it shall and may be lawful for my said Wife and her Assigns into and upon the said Tenament called Great Treheer or any part thereof to enter and distrain and the distress and distresses them and there To and to detain and Keep until all such arrears and all Costs and Expences attending the same shall be fully paid, and in default of payment thereof within five days to sell and dispose of the same and otherwise to act therein according to Law. I also give and bequeath unto my said Wife one full Moiety of all the household furniture China and Glass which I my be possessed of at the time of my decease for her own absolute use and benefit to be divided and chosen for her by two indifferent persons, one to be elected by my said Wife and the other by Executor hereinafter named.

I also give and bequeath unto my two Sons Nicholas Moon and Cornelius Moon the sum of one thousand Pounds each,

I gvie and bequeath unto my Daughter Mary Ann now the Wife of William Snell the Sum of one Pound, and I give unto the said William Snell the Sum of One Pound and unto Joseph Snell their Son One Pound.

I give and bequeath unto my two daughters Jane and Elizabeth the Sum of Three Hundred Pounds apeice,

I give unto my Daughter Susannah the Wife of Philip Trout, the Sum of one Pound and to the said Philip Trout the sum of one Pound and to Susannah their daughter the Sum of one Pound,

And I hereby request and impower my Brother in Law Richard Stephens and my friend Hugh Snell of Trevidois in the Parish of Menheniot to do and act for and on the behalf of my younger Sons and daughters until they shall severally attain the age of twenty one years And I do hereby direct that the Sum of One Thousand Pounds given as aforesaid to each of my said sons Nicholas and Cornelius be an interest declared in and payable to each such Son by my Executor hereinafter named, when and as he shall attain the age of twenty one years; and it is my Will and meaning that if either of my said sons Nicholas and Cornelius shall die before the said legacy of one Thousand Pounds Pounds so given, given to him shall have become payable to him that the same should go and belong to the Survivor of my said two Sons and be vested in and payable to him at the same time as his own Legacy of one Thousand Pounds as aforesaid given to him and the said Sum of Three Hundred Pounds to each of my said Two Daughters be an interest vested in and payable to each such daughter when and as she shall attain the age of Twenty one years or Marry but it is my Will and meaning that if either of my Said daughters Jane and Elizabeth shall die before her said legacy of Three hundred Pounds so given to her shall have become payable to her that the same go and belong to the Survivor of my said Two Daughters and be vested and payable to her at the same time as her own Legacy of Three hundred Pounds so given to her and I do hereby declare my Will and meaning to be that my Executor hereinafter named shall provide and supply to my said two Sons and to my said two Daughters Jane and Elizabeth proper and sufficient board lodging Meat drink Washing Clothing and all other Necessaries and conveinences fit for them until the provision and Fortune herein before made and given to them shall become vested in them and payable, and I hereby charge and make liable all my Freehold ___________ and Customary lands and hereditaments which I shall die seized and possessed of with the payment of the said Legacies respectively and with the ____ and ________ _____________ of my said Sons and Daughters as aforesaid

All the rest residue and remainder of my Messuage Lands and Tenaments real and personal Estate Money Securities for Money Goods Chattels rights and credits whatsoever after payment of my just Debts legacies and General Expences, I do hereby give devise and bequeath unto my Son Edward Moon his Heirs Executors and Administrators and Assigns to and for his and their own absolute use and benefit.

And I do hereby nominate constitute and appoint my said Son Edward Moon whole and Sole Executor of this my last Will and Testamnet hereby revoking and making void all former Wills by me at anytime heretofore made and declaring this my only true and last Will and Testament. In Witness whereof I the said Nicholas Moon have to this my last Will and Testament set by hand and Seal this nineth day of April one thousand eight hundred and twenty one

The before written Will of the before named Nicholas Moon Gent. deced is a true Copy Compared & examined with the original this 15th day of November 1826 By us.

The before written Will of the before named Nicholas Moon Gentleman deced was proved in common form 15th June 1826 Before John Wallis the younger Clerk Surogate etc. And Administration of all and Singular the Goods etc of the said deced and any way concerning the said Will was granted to Edward Moon the Son of the said Deced & Sole Executor named in the said Will.

Being first sworn etc Saving etc.


Now to recap the family and will of my 4th great grandfather, He had 4 daughters and 4 sons. His sons were Edward Moon, Nicholas Moon, Jospeh Moon who died about the age of 1 and was not therefore in his father's will, and Cornelius Moon. His daughters were Susanna Moon, my 3rd great grandmother who married Philip Trout, Mary Ann Moon who married William Snell, Jane Moon who had not yet married at the time of the writing of her father's will though she would marry George Raby, and Elizabeth Moon who would die a spinster. All four of the living daughters and the three living sons where named in Nicholas Moon's will.
