The will of George Raby late of Pool Hall in the Parish of Menheniot in the County of Cornwall Gentleman deceased who died 4 April 1867 at Pool Hall aforesaid was poved at Bodmin by the oaths of Charles Moon of Pool Hall aforesaid Gentleman, Richard Luskey of Knighton in the Parish of Lewannick in the County aforesaid Yeoman, and Edmund Tucker the Younger of Molennick in the Parish of St. Germans in the County aforesaid Yeoman the Executors. of Keverell at St Martin by Looe, 1844 This is the last Will and Testament of me George Raby of Keverell in the parish of Saint Martins by Looe in the County of Cornwall Gentleman I give and bequeath unto my dear Wife Jane Raby during her Widowhood All the plate linen china Household goods and furniture of all kinds which shall be in my Dwelling house at the time of my death All the rest residue and remainder of my personal estate and effects of what nature or kind so ever And (after the decease or second marriage of my said Wife) the said plate linen china household goods and furniture And all my real estate whatsoever or wheresoever I give devise and bequeath unto my said Wife, my Uncle Hugh Snell my Brother John Raby, and my friend Charles Moon To hold to them their heirs executors administrators and assigns Upon the Trusts following (that is to say) Upon Trust that they my said Trustees or the survivor of them or the heirs executors or administrators of such survivor do and shall by with and out of my said real and personal estate or by with and out of the rents and profits thereof or by said demise or mortgage thereof or of a sufficient part or parts thereof or by such other ways or means as they may think proper as soon as conveniently may be after my decease levy and raise such sum and sums of money as may be necessary for the payment of my just debts funeral and testamentary expences And upon Trust that they my said Trustees do and shall by all or any of the ways or means aforesaid in the ... next place raise and levy and with all convenient speed pay unto my said Wife for and instead of mourning the sum of Fifty pounds And upon further Trust that they my said Trustees by the ways and means aforesaid do and shall in the next place raise and levy one Annuity or yearly sum of Sixty pounds clear of all deductions and abatements whatsoever, to be paid and payable to my said Wife and her assigns during her life by equal quarterly payments the first thereof to be made at the expiration of three calendar months next after my decease And upon trust that they my said Trustees do and shall in the next place by all or any of the ways or means aforesaid and at such time or times as they shall deem meet levy and raise unto or for each of my four daughters Susanna Snell Raby, Charlotte Raby, Jane Raby and Fanny Raby Witnesses the sum of One thousand pounds to be paid and payable to my said Daughter Susanna Snell Raby on her attaining the age of twenty three years and to each of my other Daughters respectively when and as they shall severally reach the age of twenty one years or be married (with the full consent of them my said Trustees or three of them of whom my said Wife shall be one) which shall first happen And I direct and declare that in the mean time and until my said Trustees by virtue of the power aforesaid shall have raised and levied out of or from my said Estate the said several sums so bequeathed to my said Daughters respectively as aforesaid the same sums respectively shall remain and by charged and chargeable on my said Estate with interest respectively after the rate of Four pounds per centum per annum from the time of my decease And I further direct that in case any or either of my said Daughters shall be unmarried and under the age of twenty one years when the sum or sums of money so bequeathed to them as aforesaid shall be raised and levied out of or from my said Estate in manner aforesaid That then my said Trustees do and shall as soon as conveniently may be after having so raised and levied the same as aforesaid, lay out and invest the same sum or sums of money respectively … in the names of them my said Trustees upon such good and sufficient Security at interest as they in their discretion shall think fit And I direct and declare that the interest dividends and annual produce of the said sum and sums of money so bequeathed to my said Daughters respectively as aforesaid shall during their minorities respectively, or until their marriage respectively under the age of twenty one years as aforesaid be paid and payable to my said Wife in lieu of and compensation for their support maintenance and education respectively And I appoint my said Wife during her widowhood and the said Hugh Snell, John Raby and Charles Moon Guardians of my said Daughters respectively until they reach their respective ages of twenty one years Provided always and I hereby will and direct that in case any one or more of my said Daughters shall happen to marry without having first obtained the consent of their said Trustees and Guardians or three of them of whom my said Wife shall be one Or shall die unmarried Witnesses and without having reached the age of twenty one years Then the sum or sums so given to her or them respectively as aforesaid shall be paid and payable unto my Son George Raby on his attaining the age of twenty one years
And I do hereby direct and declare that subject as aforesaid my said Trustees shll stand
seized and possessed of the residue or surplus of my said real and personal estate In trust for
my said Son George Raby his heirs executors
administrators and assigns and to convey assign transfer and pay the same
to him when and as soon as he shall reach the age of twenty one years And in the mean time and until he
shall attain that age I appoint my said Trustees the Guardians and Protectors of his person and estate And I
declare that it shall be lawful for my said Trustees during the minority of my said Son by with and out of
such surplus or residue as aforesaid, or the interest rents and annual proceeds thereof to advance and pay
all such sum and sums of money as they may deem expedient for his maintenance support and education
and advancement and preferment in the world .. And during the minority of my said Son I declare that it
shall be
And lastly I hereby nominate and appoint my said Wife the said Hugh Snell, John Raby, and Charles Moon Executrix and Executors of this my Will And I hereby revoke all former and other Wills by me at any time heretofore made and declare this to be my last … Will and Testament In Witness whereof I the said Testator have to the three former sheets hereof set and subscribed my name, and to this fourth and last sheet have set my seal and subscribed my name this sixth day of July in the year of our Lord one thousand eight hundred and forty four. And Admion of all and singular the Goods &c of the said deceased and any way concerning the said Will was Granted to Jane Raby the Widow Charles Moon and John Raby three of the Executors named in the said Will Reservation to Hugh Snell the other Executor.
